There is another point to consider. Generally when I get a car part replaced under warranty. They just take my word for the defect.

Have you considered the Malleable option? Just a point to consider. Here in the USA. Many of the top malpractice attorneys have also received their medical degree. Medical cases can be so complicated that it really helps to have a lawyer that has a medical background.
